The negative and false statements being written, sent out and provided by "Joseph Mitchell and others", who has not only illegally hacked and taken over the puntaperla.com website, but has also stolen the private commercial information within the domain, that is the private property of Punta Perla and using said information and web site - email addresses in order to send out false information trying to cause damage, harm and derail the Punta Perla development has been denounced and is being investigated and have been identified by the cyber crimes department ",DICAT", of the Dominican National Police.

In case you have not received the letter sent out by the Legal Department of Punta Perla a couple of weeks ago, please find attached find a new original and a translated copy of the letter from the District Attorneys office of the Dominican Republic, represented by Mr. Montes de Oca, with the corrected email address for him, along with a letter certification from the cyber crimes department, DICAT, of the National Police confirming Punta Perla’s formal accusations against these criminal elements and illegal acts.

Punta Perla can assure all of you that the local, Spanish and international police are looking for the perpetrators of these criminal acts, are pursuing this case diligently and will bring them to justice in order to bring an end to all of these criminal acts. These actions are motivated to extort, manipulate, harm, misinform, and attack directly Punta Perla, its shareholders and in consequence all of the client’s investments.

A final clarifying note regarding the puntaperla.com website, the Legal Department would like to state that this website was previously owned and managed by Mark Andrews of Emerging Earth, he formally and legally transferred the rights of puntaperla.com over to Punta Perla and Mr. Miranda. Mark Andrews has stated this in written letter to Punta Perla ( see attached email).

We hereby state that a number of formal accusations have been received from the company, PUNTA PERLA, whereby they have denounced before us, and said accusations have been and are being investigated, whereby the company has been the object of multiple cyber crime attacks, that are identified as part of LAW 53-07, on Cybercrimes and High Technology acts, in our country such as;

Extortion, blackmail, illegal access, sabotage, altering and damaging data, defamation, against its web page, hardware and electronic emails.

Once the accusations were formally received, we have initiated the corresponding investigations, in conjunction with the Office of the Attorney General, the highest representative for cases of this magnitude and order, as established in Article 91 of the Criminal Processing Code of the Dominican Republic; whereby in these investigations we have found documented proof and evidence that will be used against the alleged perpetrators that have been identified ;we are working with the international intelligence agencies as well as with sister police departments that handle these cases in the countries where these cyber delinquents reside, working through the legal process , agreements and international treaties , in order to formally arrest and submit to justice said criminals in order to formally respond to the stated accusations, through the Office of the Attorney General.

We hereby state that Punta Perla has declared before our office the theft, manipulation, extortion of the domain, email addresses, and messenger accounts of their clients along with other criminal acts that have grave consequences for the company, its executives, employees, investors and clients in general.

In this regard we are initiating all legal actions to locate said individuals in order to identify and bring to Justice place under the legal system the person (s) responsible for said criminal acts, which are premeditated and perverse, in order to distort and confuse the real status of the Punta Perla development project.

We are requesting as well the collaboration of all individuals who have received said emails or communications, written against Punta Perla and or its executives, to remit these emails and or written statements to the following email address of the undersigned, pefeliz@pgr.gob.do, in order to avoid any further fraud and or misunderstandings, as these acts are orchestrated by individuals and or groups of international criminals that know how to manipulate and control electronic information in order to confuse and damage the good faith of all third parties.

The email accounts that we have been able to identify during our initial investigations initiated by the DICAT (Technological Criminal Department) and the Department of Intellectual Property of the Attorney General Office of the Dominican Republic (PROPINTELCO) of hateful, illegal and antisocial acts penalized and registered under law 53-07 of 23rd of April 2007, incorporated to counter technological crimes and fraud are;

3.  Dear Ricardo

Further to our telephone conversation, I would like to confirm the following:-

1. I am the owner and CEO of Emerging Earth, the original owners of the domain puntaperla. com
2. Emerging Earth was the original sales and marketing company in the UK and Ireland for the Punta Perla project.
3. Earlier this year I transferred the domain to Ricardo Miranda the President of Punta Perla
4. I did not transfer the domain to Shannon Lynne Cadagan, she was just the secretarial administrator to Ricardo Miranda and had no rights over or for the domain at all.
5. Right now my normal email server is down though I should be able to confirm all of this with supporting emails used during the transfer hopefully in the next two days.
